This Acceptable Use Policy
specifies certain actions prohibited by Living Stones New
England for users of the Living Stones New England Network.
Living Stones New England reserves the right to modify this
Policy at any time to stay in compliance with any laws,
regulations and security requirements. By signing up for
and using Living
Stones New England services, any customer, employee or third
party unconditionally accepts the terms of this Acceptable Use
Policy.
Illegal Use
The Living Stones New England
Network and servers may be used for lawful purposes only.
Transmission, storage, or distribution of any information,
data, or material in violation of any applicable law or
regulation, or that may directly facilitate the violation of
any particular law or regulation is prohibited. This includes,
but is not limited to: copyrighted material; trademarks; trade
secrets or other intellectual property rights used without
proper authorization; material that is obscene, defamatory,
constitutes an illegal threat, or violates export control
laws. Examples of unacceptable content or links include:
pirated software, hacker programs or archives, Warez sites,
MP3, and IRC bots. Any violation of the above which
compromises the integrity of the Living Stones New England
Network or any other network is strictly prohibited.
Adult Content
Adult-oriented sites,
pornography and hard core sex-related sites are prohibited.
This includes sites that may infer sexual content or provide
links to adult content elsewhere. This is also true for sites
that promote any of these kinds of illegal activity or
content.
Network and Machine
Resources
Living Stones New England
reserves the right to monitor and allocate network and machine
resources. Any web site that uses a high amount of server
resources (such as, but not limited to, CPU time, memory
usage, and network resources) will be given the option to
either pay additional fees (which will depend on the resources
required), reduce the resources used to an acceptable level,
or upgrade its service to a Dedicated Server plan. Living
Stones New England shall be the sole arbiter of what is
considered to be a high server usage level and
Living Stones New England in its
sole discretion and upon reasonable notice to customer
reserves the right to discontinue any hosting account and/or
any script which causes excessive server load and/or uses
excessive server and network resources.
Any web hosting account
deemed to be adversely affecting server performance or network
integrity will be shut down without prior notice. This
includes accounting running services on ports higher than 80.
CGI script sharing with
domains not hosted by Living Stones New England is not
permitted. Any CGI-scripts deemed to be adversely affecting
server performance or network integrity will be shut down
without prior notice.
Living Stones New England does
not allow customers to install their own chat rooms. Chat
rooms tend to require significant system resources and
therefore cannot be permitted as an account option.
Living Stones New England does
not allow programs to run in the background.
Living Stones New England does
not allow IRC or IRC bots to be operated on our servers.
UCE (Unsolicited Commerce
Email) - Spamming, the sending of unsolicited mass email from
or through a Living Stones New England server or using an
email address that is maintained on a Living Stones New
England machine is STRICTLY prohibited. Living Stones New
England will be the sole arbiter as to what constitutes a
violation of this provision. Customers are also in violation
of this provision if they engage in spamming using the service
of another ISP or IPP, but reference in the spam a web site
hosted on a Living Stones New England server, or if they sell
or distribute software on their web site that facilitates
spamming. Violators will face immediate suspension.
Posting the same messages to
multiple newsgroups (excessive cross-posting or
multiple-posting, also known as "SPAM") is expressly
prohibited.
Any attempts to undermine or
cause harm to a Living Stones New England server or customer
are strictly prohibited.
Living Stones New England's
shared web hosting accounts are not configured for the
purposes of distributing software and/or multimedia products.
If you wish to distribute software and/or multimedia files,
please contact Living Stones New England to make special
arrangements.
Multimedia files are defined
as any graphics, audio, and video files. Living Stones New
England shared web hosting accounts are not to be used for the
purposes of distributing and storing unusual amounts of
multimedia files. Any web site whose disk space usage for
storing multimedia files exceeds 70% of its total usage, in
terms of total size or number of files, will be considered to
be using an unusual amount of multimedia files.
To protect Internet, network,
and machine resources on behalf of the entire Living Stones
New England customer base, no individual customer may resell
or give away web space under a domain name, or create
sub-domain web sites on behalf of other companies, groups,
or individuals.
Living Stones New England may
immediately suspend service without prior notice to any web
site that violates these rules. In the event of any dispute
regarding these rules, Living Stones New England may determine
violations of these rules in its sole discretion.
Customers utilizing bandwidth in
excess of plan limitations, or in violation of these rules,
will owe Living Stones New England compensation therefore at
the applicable rate for excess bandwidth.
The failure by a customer to
meet or follow any of the above Terms of Use is grounds for
account deactivation. Living Stones New England will be the
sole arbiter as to what constitutes a violation of the Terms
of Use. Living Stones New England reserves the right to remove
any account without prior notice. When Living Stones New
England becomes aware of an alleged violation of its Terms of
Use, Living Stones New England will initiate an investigation.
During the investigation, Living Stones New England may
restrict a customer's access in order to prevent further
potentially unauthorized activity. Depending on the severity
of the violation, Living Stones New England may, at its sole
discretion, restrict, suspend, or terminate a customer's web
hosting account and/or pursue other civil remedies. If such
violation is a criminal offense, Living Stones New England
will notify the appropriate law enforcement authorities of
such violation.
Living Stones New England does
not issue credits for outages incurred through service
disablement resulting from Terms of Use violations.
System and Network Security
Violations of system or network
security are prohibited and may result in criminal and civil
liability. Examples include but are not limited to the
following: unauthorized access, use, probing, or scanning of
systems security or authentication measures, data, or traffic;
interference with service to any user, host, or network
including, without limitation, mail bombing, flooding,
deliberate attempts to overload a system, broadcast attacks;
forging of any TCP-IP packet header or any part of the header
information in an email or a newsgroup posting.
Violations of system or network
security are prohibited, and may result in criminal and civil
liability. Living Stones New England will investigate
incidents involving such violations and may involve and
cooperate with law enforcement authorities if a criminal
violation is suspected. Living Stones New England respects the
privacy of customer data and vigilantly protects that data and
ALL customers who host with Living Stones New England. If any
violation of the law or this AUP is suspected, Living Stones
New England reserves the right to investigate. Use of the
Living Stones New England network constitutes consent to
monitoring. Examples of unlawful
acts, system, or network security violations include, without
limitation, the following: Unauthorized access to or use of
data, systems or networks, including any attempt to probe,
damage, scan or test the vulnerability of a system or network
or to breach security or authentication measures without
express authorization of the owner of the system or network.
Unauthorized monitoring of data or traffic on any network or
system without express authorization of the owner of the
system or network. Interference with service to any user, host
or network including, without limitation, mailbombing,
flooding, deliberate attempts to overload a system and
broadcast attacks. Unauthorized access to any data, system, or
network from an unauthorized system or network for any purpose
which is not lawful or which is intended to do harm. Forging
of any TCP-IP packet header or any part of the header
information in an email or a newsgroup posting. Electronic
forging of any kind to include but not limited to IP
addresses, domains, business names, etc.
If you have a complaint in regards to illegal Use
or System or Network Security issues, email abuse, or USENET
abuse or SPAM, please inform us using the
feedback form.
Interaction With Living Stones New England
Any threat, vulgar and profane
language directed at any Living Stones New England staff
member through phone or email may result in immediate
termination of an account. Any violation of this policy by any
employee, contractor or third party programmer of Living
Stones New England should be reported immediately using the
feedback form. Let's work together

prosperous and responsible Internet community.
Monitoring
Online Postings
Living
Stones New England has the right to monitor and review the
content of any discussions, chats, forums, postings,
transmissions and bulletin boards. Living Stones New England
expects visitors to our sites, and anyone using our site, to
adhere to an appropriate standard of decency that Living
Stones New England consider appropriate. Living Stones New
England is the sole authority on any questions of
appropriateness for our sites. Living Stones New England does
not assume any responsibility or liability arising from the
content of an online posting, but, we do specifically prohibit
you or any visitor from posting or transmitting any unlawful,
threatening, libelous, obscene, scandalous, inflammatory,
pornographic, or profane material or any material that could
constitute or encourage what could be considered a criminal
offense, give rise to civil liability or otherwise violate any
law.
Living
Stones New England will fully cooperate with authorities or
court orders that request the details of criminal postings.
Living Stones New England shall have the right in its sole
discretion to edit, refuse to post or remove any material
submitted to or posted on any Living Stones New England web
site and shall have the right to remove any material that it
determines to be in violation of these provisions or finds
anywise objectionable.
Indemnify and Hold Harmless
Living Stones New England
customers agree to indemnify and hold harmless Living Stones
New England from any claims resulting from the use of our
services that damages them or any other party. The Living
Stones New England service is provided on an as is, as
available basis without warranties of any kind, either express
or implied, including, but not limited to, warranties of
merchantability, fitness for a particular purpose or
non-infringement. Living Stones New England expressly
disclaims any representation or warranty that the Living
Stones New England service will be error-free, secure or
uninterrupted. No oral advice or written information given by
Living Stones New England, its employees, licensors or the
like, will create a warranty; nor may you rely on any such
information or advice. Living Stones New England and its
partners and suppliers will not be liable for any cost or
damage arising either directly or indirectly from any
transaction or use of the service.
